Buhari Insulted Osinbajo Before Leaving – Fani-Kayode

 Femi Fani-Kayode has claimed that President Muhammadu Buhari referring to VP Yemi Osinbajo as a “co-ordinator” and not Acting President, is “insulting and dangerous”.

Buhari flew out of the country Sunday night, to undergo further medical check-ups in the UK. He sent a letter to the Senate notifying the upper chamber of his absence.

The Senator representing Abia-North at the National Assembly, Mao Ohuabunwa, on Tuesday, said the transfer of power from Buhari to Yemi Osinbajo was not clear.

Fani-Kayode has reacted to the development:

“The attempt by the corpsocrats to prevent the VP from being Acting Pres. by referring to him as a ‘co-ordinator’ is insulting and dangerous. 
“It is time for us to decide: do we have a nation of equals or not?If not let us break it! When u tell us that the VP cannot be Acting President. 
“Even though the Pres. is critically sick and on indefinate medical leave u are playing with fire. There are NO more slaves in Nigeria.”

  4. Was the choice of words an honest blunder or an intended mischief ? Whatever the case, Section 145 of the Constitution is clear to the effect that "whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them a written declaration to the contrary such functions shall be discharged by the Vice-President as Acting President. ''
    The words used by the President in his letter to describe the role of the Vice-President in his absence are immaterial as the Constitution has already described the capacity of the Vice-President in his absence as "Acting President" !

Had the President proceeded on vacation to London without notifying the President of the Senate and Speaker of the House of Representatives, Prof. Osinbajo would have continued to "coordinate the activities of the government" as Vice President for the next 21 days, after which the National Assembly shall pass a resolution empowering him to perform the functions of the office of President in line with Section 145 (2) of the Constitution.
    Interestingly, Mr. Buhari had expressly indicated in his written declaration that he was writing pursuant to Section 145 (1) of the Constitution. This forecloses any contrary inference on his intentions other than for Osinbajo to become the Acting President.
    It should, however, be noted that it was not necessary for the President to expressly indicate that his written declaration was made pursuant to Section 145 (1) of the Constitution. It was equally superfluous for him to state the nomenclature, status or functions of his Vice while he is on vacation. The Constitution has already catered for this.
    Therefore fani kayode you cannot incite us against our dear president doing what you people failed to do when you were there. Wish you quick recovery my dear president .

  12. I can't figure out any mistakes with the letter pmb forwarded to the Senate in respect to his vacation . Osibanjo power to preside is even doubled. He is second in command, the law recognized him as the acting president and also he co-odinates.
